Holders May Apply for U.S. Permanent Residency without a
Waiver
J1 holders subject to Two-Year Foreign Residence
Requirement may file I-140 application for U.S.
Permanent Residency before receiving a waiver of the
two-year foreign residence requirement.
After I-140 application is approved, the J1 applicant
may either:
Apply for a waiver of the J visa two-year foreign
residence requirement, then file I485: Application for
Adjustment of Status, or
To satisfy the two-year foreign residence requirement,
then apply for U.S. Permanent Residency at the U.S.
Consulate abroad.
