We helped a researcher with 20 citations win Approval of
I-140 EB2NIW Green Card application.
Recently, our law firm helped a researcher in the
research field of biomaterials and nanoparticles receive
an approval of her I-140 NIW petition from the USCIS
Nebraska Service Center (NSC).
The client received her M.S. degree in Chemistry and has
been working as a research associate at a private
company in the U.S. Her current research focuses on
screening and design of experiment for small molecule
drug candidates.
Although her employer may file an employer-sponsored
green card application, she made an intelligent decision
to file EB2NIW because EB2NIW gives her freedom to
change jobs and employers during the green card
application process so long as her new job is in her
area of specialty and serves the national interest of
the United States. Our client realized that job-changing
was quite likely to happen in high-tech areas. EB2NIW is
a safer play for her green card application.
For filing her EB2NIW petition, Client had prepared the
following documentary evidence based on our 'Document
Preparation Instructions': 1) about 5 papers published
in professional peer-reviewed journals, such as Chemical
Communication and Tetrahedron, etc.; 2) 2 conference
presentations; 3) about 20 citations of her published
papers; and 4) 5 recommendation letters. To expedite her
NIW document preparation process, we provided
substantial legal services to our Client.
Through the drafting and revision process between Client
and our law firm, we helped Client describe in detail in
her expert opinion letters regarding how her research
results/findings have been used, implemented, or
referenced by other researchers in related fields, and
identify some prominent or leading scientists citing the
applicant’s work and how their work was influenced by
the applicant’s work.
For example, novel protected monomers developed by
Client were repeatedly used by other research
laboratories and companies for biological researches.
This was exemplified by providing detailed information
on leading scientists who used Client's findings and
cited her works. Through her expert opinion letters and
citation evidence, Client sufficiently demonstrated that
some of leading scientists from around the world have
acknowledged the value of her work and its important
significance in the field of antibiotics and anticancer
therapeutics.
Client's I-140 EB2NIW petition was recently approved
smoothly without CIS Request for Evidence (RFE).
